VisualDx Image and Content Use Policy

 

Copyright Notice

All images and content contained in VisualDx (the “Software”), including, without limitation, medical images, illustrations, captions, diagnostic texts and associated medical findings, are the copyrighted property of VisualDx and are protected by applicable copyright, intellectual property, and international treaty laws.

By accessing or using the Software, you agree to comply with this Policy in its entirety. VisualDx reserves the right to monitor your use of the Software and to enforce compliance with this Policy.

 

Use of VisualDx Images and Content During a Free Trial or for Individual Subscribers

If you are using or accessing the Software during a free trial period or as an individual subscriber, you may not use the images or content contained in the Software in any way other than viewing them within the Software. Any other use by you is strictly prohibited, including, without limitation, the prohibited uses described below.

 

Use of VisualDx Images and Content for Institutional Subscribers

If you are using or accessing the Software through an institutional subscriber, you may copy or link to images and content contained in the Software for your clinical or educational use but only for consulting with individual colleagues, patient, student and staff education, inclusion in a patient’s electronic health records (EHR), and inclusion in educational materials (lectures, handouts, and other teaching materials) presented within your institution.

Educational material containing images and content from the Software may be added to your institution’s centralized, institutional learning management systems so long as the images and content remain within the context of access-controlled, specific course material within your own institution. You may not crop, expand, edit, or otherwise modify or alter any images contained in the Software, and VisualDx’s copyright watermark notice on images must remain intact and visible wherever the image appears and must include the source reference: Image source: VisualDx (visualdx.com). All educational material containing images or content from the Software must be deleted from your institution’s centralized, institutional learning management systems upon termination of your institution’s license.

Note: Use of the Software is restricted to current VisualDx subscribers and the rights to use defined in this Policy. These rights to use expire when the applicable license(s) is terminated.

 

Prohibited Uses

Unless express written permission is granted by VisualDx, you may not sell, copy, download, extract, reproduce, reutilize, repurpose, modify, distribute, or otherwise commercially exploit, make available to any other person or entity, or put to public use, in whole or in part, in any way, the images and content contained in the Software, and you may not create derivative works thereof.

You may not, under any circumstances, use in marketing materials, use in any print or electronic publication or post on websites, publicly available intranet domains, public bulletin boards, social media (eg. Instagram, X, TikTok, etc.), online chat rooms, or the like, add to centralized image repositories or learning management systems (except as provided above), use in educational materials intended for distribution, circulation or delivery outside your institution (including surveys, conferences or research-based studies), use to train, test, benchmark, develop or evaluate large language models (LLMs), chatbots or similar artificial intelligence systems or any other software program, model, algorithm or generative artificial intelligence tool, or use in performing vision science, machine learning, deep learning or artificial intelligence algorithms in any way, any of the images and content contained in the Software, all of which are strictly prohibited by VisualDx.
 

Policy Updates

VisualDx reserves the right, at any time and without notice, to change, modify, add to or delete portions of this Policy, simply by posting such change, modification, addition or deletion to this Policy. Any such change, modification, addition or deletion will be effective immediately upon such posting. Your use (or continued use) of the Software constitutes your acceptance to such changes, modifications, additions or deletions. If you do not agree to and accept, without limitation or qualification, all of the terms of this Policy, do not use (or continue to use) the Software.
